Federal judge rules โ€˜pocket-vetoโ€™ provisions of MSA violate US Constitution in partial victory for NEFSA

January 6, 2025 โ€” U.S. District Court Judge John Woodcock determined some of the authority granted to those council members was violating the U.S. Constitution, specifically a portion of the MSA which meant the NFMS was unable to repeal certain fisheries management procedures without council approval. By refusing to assent to decisions made by the NFMS, the council could effectively โ€œpocket vetoโ€ decisions made by federal authorities.

โ€œIn severing these limited provisions, the Court addresses both the Appointments Clause and constitutional removal claims, as, without these provisions, the Council Members do not exercise any significant authority, and thus, do not constitute officers of the United States,โ€ Woodcock wrote. โ€œThis resolves the constitutional issues presented without invalidating an entire statutory scheme that has effectively governed the United States for decades or a regulation that did not involve either of the constitutional provisions identified in the case at bar.โ€

Fishing industry reels over Bidenโ€™s destructive wind farm plan: Itโ€™s โ€˜coming at us from every directionโ€™

March 27, 2024 โ€” Time is running out for fishermen and women in the Northeast who fear their industry is being put at risk by the Biden administrationโ€™s renewable energy agenda.

โ€œGround fishermen, lobstermen, whatever you are, youโ€™re under the microscope right now, and it just seems to be something coming at us from every direction,โ€ New England Fishermenโ€™s Stewardship Association (NEFSA) COO Dustin Delano said on โ€œThe Big Money Showโ€ Monday.

โ€œAnd with this offshore wind agenda out there to attempt to fight climate change,โ€ he continued, โ€œitโ€™s almost like environmentalists and different folks are willing to destroy the environment to protect the environment.โ€

Two weeks ago, the Bureau of Ocean Energy Management (BOEM), an agency within the Department of Interior, announced the finalization of what is known as a wind energy area (WEA), which is an area of the ocean that would allot for construction of enough wind turbines to produce 32 gigawatts (GW) of energy.

Fishermen slam Biden adminโ€™s offshore wind push as threat to jobs, sea life

August 9, 2023 โ€” New England fishermen are sounding the alarm on studies that reveal offshore wind turbines emit electic currents that are deforming lobster and haddock, and โ€œimitate effects of climate changeโ€ by raising ocean surface temperatures.

The New England Fishermenโ€™s Stewardship Association (NEFSA) on Monday released an Offshore Wind Research Summary, a compilation of scholarly articles that identify dangers offshore wind farms pose to ocean ecosystems.

NEFSA concluded that there is โ€œno scientific consensus as to the effects of offshore wind on ocean ecosystems and marine life,โ€ and is demanding that the Biden administration conduct the necessary studies before green-lighting offshore wind.
