State official: NY commercial fishermen ‘getting a raw deal’

November 13, 2017 — New York commercial fishermen are “getting a raw deal” in federal fisheries quotas, and the state will follow through on a lawsuit early next year if meetings in December don’t fix the problem, the state’s top fisheries official said last week.

At a meeting at the East Hampton Public Library on Thursday, Basil Seggos, commissioner of the state Department of Environmental Conservation, listened to two full hours of complaints about state and federal regulations and management of fisheries, including restrictive quotas, inaccurate fish-population data, difficulty in getting and transferring permits, and “Gestapo”-like tactics of federal observers on local fishing vessels.

Seggos in an interview after the meeting said the state would base its response to federal regulators “on the numbers we get” in the federal quota following a meeting of an interstate commission in December to divvy up the quota for fluke and other species.

The Future Of Offshore Wind Farms In The Atlantic

November 13, 2017 — Fishermen are worried about an offshore wind farm proposed 30 miles out in the Atlantic from Montauk, New York, the largest fishing port in the state. They say those wind turbines – and many others that have been proposed – will impact the livelihood of fishermen in New York and New England.

Scallop fisherman Chris Scola pulls out of a Montauk marina at 2 a.m. and spends the next two-and-a-half hours motoring to an area about 14 miles out into the Atlantic. Then, with the help of his two-man crew, spends about 10 hours dredging the sea floor for scallops before heading back to port.

“We have this little patch that’s sustained by myself and a few other boats out of Montauk and a couple of guys from Connecticut also fish down here.”

Scola gives me an earful about state and federal regulations, but the thing that really has his dander up these days is the prospect of hundreds, and perhaps even thousands, of giant wind turbines spread out in the New York Bight, an area along the Atlantic Coast that extends from southern New Jersey to Montauk Point. It’s one of the most productive fishing grounds on the Eastern Seaboard.

“To me, building windfarms here, it’s like building them on the cornfields or the soyfields in the Midwest.”

Scola belongs to the Long Island Commercial Fishing Association, which is run by Bonnie Brady, the wife of a longtime Montauk fisherman. She’s an outspoken critic of the windfarms.

New York Commercial Fishermen Want Gov. Cuomo to Sue Federal Government Over Fluke Quota

October 10, 2017 — Several dozen fishermen, women and lawmakers last week urged Gov. Andrew M. Cuomo to make good on a promise to sue the federal government over New York’s disproportionately low share of the fluke fishery.

At a meeting at East Hampton Town Hall last Wednesday, the gathering of fishing interests sought to unify their agenda before a meeting with top state officials scheduled for next month.

The commercial fishery for fluke was shut down in September for the first time in recent memory. It reopened Oct. 1 with a 50-pound daily limit. New York gets 7.6 percent of the commercial fluke quota, while North Carolina and Virginia get more than 20 percent each.

Chuck Morici, a Montauk commercial fisherman, used an empty fish basket to demonstrate the inequities. New York’s current daily quota fills the basket by about a third, he said, while boats from Virginia can take 153 baskets — about 10,000 pounds.

Montauk Remains The Largest Commercial Fishing Port in New York State

October 2, 2017 — While commercial fishing goes back to the late 17th Century in Cape May, it has been based in Montauk on the very eastern tip of Long Island for nearly that long. Montauk is the largest commercial fishing port in New York State today. WBGO’s Jon Kalish recently went out with a commercial fishing vessel to see what the work is like.

NEW YORK: Strained Fluke Quotas, Hurricanes and Safe Harbor

Case of fisherman bound for North Carolina caught in José’s rough seas highlights inadequacies in interstate fishing regulations

September 29, 2017 — Less than a month after a bill granting vessels safe harbor in New York was signed by Governor Andrew Cuomo, a fishing vessel bound for North Carolina carrying 6,000 pounds of fluke has tested the new policy, straining New York’s federally designated fluke quotas.

The F/V Rianda S., which has long been a part of the Montauk fleet, was in transit to land its fish in North Carolina, where it has fishing licenses, on Sept. 17 after fishing in federal waters when it encountered the rough seas generated by Hurricane José and requested safe harbor in Montauk.

New York’s fluke fishery is closed for the month of September, due to banner fluke landings this summer that strained the state’s already low federally mandated quotas.

The law granting safe harbor, sponsored by South Fork State Assemblyman Fred Thiele and East End State Senator Kenneth LaValle, allowed vessels fishing with licenses from other states immunity from prosecution for violations of state fishing regulations if they seek safe harbor under certain emergency situations, including weather, mechanical breakdown, medical emergencies and loss of essential gear that renders vessels unable to remain at sea.

The New York State Department of Environmental Conservation (DEC) guidelines for safe harbor were drawn with input from commercial fishermen after an incident in January 2015, when the arrival of bad weather forced a commercial fisherman with New Jersey fishing permits to land his fish in Hampton Bays instead of continuing on to New Jersey.

IUU Fishing off Montauk Exposed as NY Fines Party Boat Taking Illegal Sea Bass and Dumping Fish

September 20, 2017 — State marine enforcement officers issued eight tickets and 22 warnings last month after people aboard a party boat were spotted throwing “hundreds of pounds” of illegal fish overboard in Montauk Harbor, authorities said.

The boat was later found to have hundreds more undersized and over-the-limit fish — a combined 1,000 fish in all, authorities said last week.

The Department of Environmental Conservation, in an email, said a marine enforcement unit was patrolling Montauk Harbor Aug. 31 when officers confronted fishermen on the boat, Fin Chaser, who were tossing fish overboard. Anglers ignored orders to stop, the DEC said

Once at the Star Island Yacht Club dock in Montauk, officers discovered 500 fish in 17 coolers. They issued tickets and warnings for possession of undersized black sea bass and fluke, excess possession of sea bass and scup, failure to stop dumping on command and an incomplete vessel trip report.

NEW YORK: State, Fishermen Map Out Possible Conflicts At Sea To Help Clear Way For Future Wind Turbines

August 23, 2017 — Commercial fishermen from throughout the South Fork last week pored over nautical charts showing the broad swaths of ocean south of Long Island being considered for future wind energy development by New York State—and saw a lot of the area where they harvest a living.

But the state officials who hosted two open-house discussions with fishermen last week, one at Shinnecock Inlet and the other in Montauk, said that is exactly what they wanted the fishermen to point out to them—so they can work to reduce the impact.

The New York State Energy Research and Development Authority, or NYSERDA, is nearing the end of the research phase of its offshore wind master plan, due to be released next year. The state’s experts say they wanted to hear from fishermen which areas are most critical to their industry, and how the development of offshore wind farms could be coordinated to have the least impact on the fishing industry as possible.

“What we’re trying to understand from the fishermen is where they fish in these areas, how often they fish in what spots, what type of fishing they do in each area, and … we want to understand how the gear works,” said Greg Matzat, a wind energy expert for the Research and Development Authority. “If we can find areas where there is no fishing, or less fishing, happening, that’s where we want to go. If it makes sense that we would align the turbines along a depth contour, so that fishermen can fish alongside them and don’t have to criss-cross through them, we can do that, too.”

Governor Andrew Cuomo last year set a goal for the state to draw half of its energy supply from renewable sources by the year 2030. A large portion of that is expected to come from offshore wind developments—some 2,400 megawatts from 250 wind turbines, enough to power more than one million homes.

As part of its master plan development, the state is looking at more than 16,000 square miles of ocean, from the full length of Long Island coastline out to the continental shelf, to find the conditions right for potential development sites for offshore wind farms.

The Scallops Are Amorous

June 9, 2017 — It’s bit premature to start talking about bay scallops. After all, the season doesn’t get underway until Nov. 6 in state waters. But at about this time of the year, last season’s scallops that were too small for harvesting — scallops must be at least two and a quarter inches in length from midhinge to midbill and have an annual growth ring — are getting ready to have some fun in the bays and will begin to spawn (they will do the dirty deed again in September). And those offspring, more commonly known as “bugs,” that survive and grow to maturity will be the ones that can be harvested in November of 2018, as a scallop has a very short lifespan of just 18 months.

Our bay scallops, which many chefs and gourmets cherish as the most succulent and the sweetest in the world, are a commodity that can fluctuate wildly. They are very delicate and sensitive creatures that are subject to a wide variety of predators and conditions that can easily disrupt their supply from year to year. Enormous fluctuations in the New York State annual harvest have been the norm — 168,674 pounds in 1973 followed by 678,417 pounds the next year. But starting in the early 1980s, repeated brown tides and algae blooms significantly decreased the harvest, and catches have never returned to their historically high levels.

A particularly long-lasting, dark brown tide during the summer of 1996 suffocated just about every scallop and by 1997 the state recorded a scallop harvest of zero. Last season’s statistics are not in yet, but by all accounts, it was a big dud. Harvests were scarce just about everywhere and prices soared to upward of $45 a pound in some local fish markets when they were even available. As the season dragged into winter until its close at the end of March, very few boats could be seen plying our East End bays to dredge up a bushel or two for a hard day’s pay.

But last season did provide a glimmer of hope for the upcoming season, as hordes of bugs were seen in many locations on the East End, in particular in the Peconics. And the few dozen of those little guys I transplanted and sprinkled around my boat slip last November also seemed to have survived the winter in good condition. However, whether Mother Nature will cooperate over the next few months to ensure they survive remains to be seen. A lot can happen between now and November that will ultimately determine whether we will witness an improved scallop harvest later this fall and signs of hope for the season after that.

Here’s to a successful spawn and clean water this summer so that we can continue to savor this treasured shellfish that we are so fortunate to have in our backyard. Only time will tell.

NEW YORK: Advocates Urge Study on Importance of Fisheries

May 5, 2017 — Representatives of East Hampton Town’s Fisheries Advisory Committee this week again asked the town to help fund a comprehensive analysis of the socioeconomic importance of fisheries on the East End and reiterated fishermen’s concerns about the Deepwater Wind offshore turbine installation.

The committee would like to hire Cornell Cooperative Extension to conduct the economic analysis, and its members are seeking participation from East Hampton and other local municipalities in order to raise the $100,000 needed to pay for it.

Brad Loewen, the chairman of the fisheries committee, who is a bayman and a former town councilman, said the committee has also been examining how — or if — the State Department of Environmental Conservation considers potential detrimental effects on fisheries when assessing the impact of proposed projects, such as the offshore wind farm. With unsatisfactory responses so far from the D.E.C. to requests for information, the committee, which is working with John Jilnicki, a town attorney, may ask the town board to submit a Freedom of Information Law request for the needed documents.

While the offshore wind turbines 30 miles from Montauk Point may be inevitable, Mr. Loewen said, “the last thing we want to see is that cable go through Napeague and Gardiner’s Bays, and come ashore in the bay. It’s a disaster,” he said.

Coast Guard Rescues Man From Fishing Ship Dozens of Miles off Montauk

April 24, 2017 — The Coast Guard rescued a man who was suffering a medical emergency on a ship 65 miles south of eastern Long Island.

The 47-year-old man was lifted from the deck of the Braedon Michael after the fishing vessel contacted the Coast Guard around 8:30 a.m. Friday for help with a crewmember who was experiencing flu-like symptoms and was in and out of consciousness.

An MH-60 Jayhawk helicopter launched from an air station in Cape Cod, Massachusetts, and arrived at the ship about an hour later, where it swooped in and rushed the man to a local medical center.
