National Fisherman Highliner: Maggie Raymond

October 31, 2o23 โ€” Maggie Raymondโ€™s fishing career spans the trajectory of New England groundfish โ€“ from the good times of the 1980s, to helping fishermen and managers navigate brutal conflicts and challenges as the fleet moved to days-at-sea management and organizing into sectors.

The former executive director of the Associated Fisheries of Maine, Raymond, 70, of South Berwick, Maine, became essential to the industry and New England Fishery Management Councilโ€™s efforts to stabilize fishing communities during a traumatic era.

โ€œMaggie helped people navigate these tumultuous changes and served as an invaluable conduit to explain the science and management implications to fishermen. She was a fierce advocate for industry interests.โ€ said council chairman Eric Reid when Raymond was presented with the councilโ€™s 2022 Janice M. Plante Award for Excellence.

While working with the New England council over a quarter-century, Raymond also has been a longtime board member of the Maine Fishermenโ€™s Forum. As a member of the Maine Fishermenโ€™s Wives Association, she was active in effort to promote consumersโ€™ awareness of seafood values and Maineโ€™s fisheries.

Council Presents 2022 Award for Excellence to Maggie Raymond

January 26, 2023 โ€” The following was released by the New England Fishery Management Council:

The New England Fishery Management Council honored Maggie Raymond, former Executive Director of Associated Fisheries of Maine and a 25-year participant in the Council process, by presenting her with the 2022 Janice M. Plante Award for Excellence.

Council Chair Eric Reid called the recognition โ€œlong overdue.โ€

โ€œMaggie represents the epitome of someone dedicated to both the commercial fishing industry and sustainable fisheries management,โ€ said Chair Reid. โ€œHer tenure covers a period of tremendous change, stretching from the early days of the Magnuson-Stevens Act to our evolving adaptation to climate change and the challenges of coping with offshore wind development.โ€

Maggieโ€™s strongest connection with the Council is with groundfish, beginning around the time the Council adopted limited entry and was transitioning the entire fishery to days-at-sea management. It was a period of intense conflict between fishermen and managers, driven by fear in the industry that the changes would collapse the fishery.

MAINE: Maritime Shorts

May 3, 2021 โ€” The Maine Fishermenโ€™s Forum is hosting a safety seminar on May 4. The seminar will be 90 minutes long and include several guest speakers.โ€ฏ 

โ€œIn the last fifteen months, Maineโ€™s fishing community lost eight men to several fishing related tragedies. Commercial fishing is one of the most dangerous occupations in America,โ€ the forum wrote on the event posting. โ€œThere are several simple precautions which dramatically improve your chances of surviving an accident at sea and coming home safely to your family.โ€โ€ฏ

Trump Removing Fishing Restrictions in the Northeast Canyons and Seamounts Marine National Monument

June 8, 2020 โ€” President Donald Trump announced on Friday afternoon that he will be removing fishing restrictions in the Northeast Canyons and Seamounts Marine National Monument, opening up 5,000 square miles in the Atlantic Ocean for fishing. The order to designate that area of the Atlantic Ocean as a national monument was signed by former President Barack Obama during his final few months in office.

โ€œWeโ€™re opening it up,โ€ said Trump. โ€œToday Iโ€™m signing a proclamation to reverse that injustice, to reverse that order from the previous administration. And we are opening the Northeast Canyons and the Seamounts Marine National Monument region to commercial fishing. Is that OK? Is that what you want? Thatโ€™s an easy one.โ€

NOAA leader looks to cultivate culture of collaboration

March 1, 2018 โ€” As debuts go, Mike Pentonyโ€™s first day on the job as the regional director for NOAAโ€™s Greater Atlantic Regional Fisheries Office was a corker.

The federal government marked his ascension on Jan. 22 as only the federal government can โ€” shutting down all but the most essential government services as a consequence of the usual congressional mumbley-peg.

โ€œMy first action was to come in and proceed with the orderly shutdown of government operations,โ€ Pentony said recently during an interview in the corner office on the uppermost floor of GARFO headquarters in Gloucesterโ€™s Blackburn Industrial Park.

The respite was short-lived. The shutdown lasted a day. When it was over, the 53-year-old Pentony began his new job in earnest as the leader of the regional agency that manages some of the most historically productive โ€” and at times contentious โ€” fisheries in the United States.

It is, as his successor John K. Bullard would attest, a monumental task, working on a canvas that stretches geographically along the Eastern seaboard from Maine to North Carolina and west to the Great Lakes.

But the geographical sweep pales in comparison to the scope and density of the regulations Pentony is charged with enforcing.

There is the crisis of cod in the Gulf of Maine, the alarming demise of the North Atlantic right whales, the malfeasance of cheaters such as New Bedford fishing kingpin Carlos Rafael and a myriad of other issues that affect every fishing community within his purview.

There is incessant wrangling over habitat protections, the usual tug-of-war between environmentalists and conservationists on one side and fishermen on the other. It is a drama with a disparate cast of characters and Pentony is convinced the only way to address extraordinarily intricate problems โ€” usually requiring even more intricate responses โ€” is by forging a collaborative spirit.

โ€œI want to try to develop a culture, not just within GARFO and the agency, but within the region, both mid-Atlantic and New England, where weโ€™re all partners with a collective goal of healthy fisheries and healthy fishing communities.โ€ Pentony said. โ€œThe problems and challenges are so huge that weโ€™re only stronger if weโ€™re working together.โ€

He also understands, given the varying degrees of conflict that exist among fisheries stakeholders, that achieving that collaboration will be far more difficult than contemplating its benefits.

โ€œThereโ€™s always going to be people that find it easier to stand outside the circle and throw stones than to get inside the circle and work,โ€ Pentony said. โ€œIf they stand outside the circle and just shout about how everything is wrong, that generally doesnโ€™t do much to solve the problem.โ€

Campaign of engagement

Pentony served under Bullard as assistant regional administrator for sustainable fisheries starting in 2014. He was asked what advice his predecessor gave him.

โ€œHe told me there are a lot of people cheering and hoping for your success,โ€ Pentony said. โ€œNot just me personally, but if Iโ€™m successful, then the regional office can be successful and the agency can be successful. And if you tie that success to our mission, then our success would mean healthy, sustainable fisheries, healthy and sustainable resources and healthy and sustainable fishing communities.โ€

Pentony made his fishery management bones as a staff member at the New England Fishery Management Council prior to joining NOAA Fisheries in 2002. That experience, he said, instilled in him a solid faith in the ability of the council system to ultimately arrive at the best decision once all implications are considered.

โ€œIโ€™ve been involved with the council process for 20 years,โ€ Pentony said. โ€œItโ€™s not perfect. But I have a ton of respect for the work and effort council members put into being informed and working through what I think is unique in the federal regulatory process. We have this incredibly unique process that engages stakeholders.โ€

Pentony didnโ€™t even wait for his first official day in the big chair to begin his own campaign of engagement.

The Friday before his official starting date, he traveled to the Yankee Fishermenโ€™s Cooperative in Seabrook, New Hampshire, to meet with David Goethel โ€” a frequent critic of NOAA Fisheries โ€” and other New Hampshire fishermen to give them a sense of how he plans to approach the job.

Later that day, he had lunch in Gloucester with Vito Giacalone and Jackie Odell of the Northeast Seafood Coalition. Heโ€™s also traveled to Maine to breakfast with Maggie Raymond of the Associated Fisheries of Maine and met with New Jersey fishing companies and processors while in the Garden State on personal business.

Fishing industry awaits Rafael outcome

Stakeholders weigh in on fate of Codfatherโ€™s permits, penalties

September 22, 2017 โ€” The specter of Carlos Rafael, along with his legal baggage and trove of groundfish permits, continues to hang over the New England commercial fishing industry like a shroud that most stakeholders wish would just go away.

The sentencing of Rafael, the New Bedford fishing magnate known as โ€œThe Codfatherโ€ for his expansive vessel and groundfish permit holdings, is set to begin Monday in U.S. District Court in Boston on charges of conspiracy, lying to federal fishing regulators about the nature and size of his groundfish landings and bulk smuggling.

โ€œWe canโ€™t wait for this to be resolved,โ€ said Maggie Raymond of the Associated Fisheries of Maine.

The sentencing of the 65-year-old Rafael, who pleaded guilty in March as part of a plea deal with federal prosecutors, wonโ€™t end the contretemps. Not by a long shot.

While everyone seems to agree that Rafael should feel the full wrath of the law for his admitted misdeeds โ€” he faces up to 76 months in prison, restitution of $109,000 to the IRS and the seizure of at least the 13 groundfishing vessels used in his scam โ€” full resolution only will come when NOAA Fisheries decides the final fate of his 42 groundfishing permits.

There is no shortage of opinions of what NOAA should do.

First MSA Reauthorization Hearing Acknowledged Successes, Identified Needed Changes

August 2, 2017 โ€” SEAFOOD NEWS โ€” At the first of a series of hearings on the Magnuson-Stevens Act held yesterday at the Subcommittee on Oceans, Atmosphere, Fisheries, and Coast Guard, senators from both sides of the aisle voiced support for the regional management council system, NOAA Fisheries, and the science that supports fisheries management, despite the deep cuts proposed in the Presidentโ€™s budget.

โ€œWith regard to the budget, I think some of these cuts may not survive the [reauthorization] process,โ€ said Chairman Dan Sullivan (R-AK). โ€œI think weโ€™re going to be adding a lot back to the projects that we think are vital.โ€

Sullivan was responding in part to a series of questions from Sen. Richard Blumenthal (D-CT) to Chris Oliver, Assistant Administrator for NOAA Fisheries, about the current administrationโ€™s proposed budget for the agency.

โ€œMy question concerns the budget submitted by the president of the United States. The budget slashes funding for programs like Sea Grant and the Milford Lab at the University of Connecticut [Northeast Fisheries Science Center],โ€ Blumenthal said.

โ€œThese federal research efforts to help grow and expand certain aspects of aquaculture are very promising. As a representative of this administration, how can you justify these cuts to the agency that you are responsible for administering? Are you going to commit to me that youโ€™re going to [find funding] for Sea Grant and the Milford Lab?โ€

Oliver responded, โ€œSenator, I donโ€™t know that Iโ€™m in a position to comment very extensively on the Presidentโ€™s budget. I do know that theyโ€™ve placed a revised emphasis on the Department of Defense and national security.โ€

Blumenthal: โ€œIโ€™m on the Armed Services Committee sir, and I very much support that emphasis โ€ฆ but this kind of slashing and trashing of programs that are essential to the kinds of programs you administer, that are vital to our economic future in aquaculture I consider a mockery of the mission of your agency. And if youโ€™re not in a position to justify it, who would be?โ€

Oliver: โ€œAll I can say sir is weโ€™re going to do our best to operate within the budget that we have, and I know that a lot of the programs that were slated to be cut involve cooperative agreements or past grants of funding through the Sea Grant program, for example, and grants to the coastal states. Weโ€™re going to do our best to make that up internallyโ€ฆโ€

Blumenthal: โ€œAre you going to commit to me that you can make up those cuts to the Sea Grant program and the Milford Lab and the University of Connecticut that are essential to those programs?โ€

Oliver: โ€œI canโ€™t commit that weโ€™re specifically going to be able to make those up from our baseline budget. I think that weโ€™re facing some tough decisions too. Iโ€™ve said on many occasions that I feel that this agency may be in a position to refocus on some of its very core mission โ€“ science missionโ€ฆโ€

Blumenthal: โ€œYouโ€™d agree with me that those are valid and important programs?โ€

Oliver: โ€œOf course sir, I really do.โ€

Blumenthal: โ€œIf you agree these programs are valid, then your agency has a responsibility to fight for them and to make sure they are fully funded.โ€

The exchange was toward the end of an otherwise non-confrontational hearing on the โ€œlong overdueโ€ reauthorization of the MSA with Oliver and Dr. John Quinn, Chair of the New England Fisheries Management Council. Both men lauded the successes brought about by the original 1976 law and the amendments to it, most recently in 2007.

โ€œAs a group, we are strong believers in the Magnuson-Stevens Act โ€“ and not just because it established the Councils,โ€ said Quinn, who spoke on behalf of the Council Coordination Committee (CCC), which is made up of the chairs, vice chairs, and executive directors of the eight Regional Fishery Management Councils.

โ€œThe outcome of our management success is clear: commercial, recreational, and subsistence fisheries are key contributors to our coastal communities and the nationโ€™s economy. In large measure, this is because the Act structured a very successful approach to sustainable fisheries management. Central to the Act are the 10 National Standards that guide our management process.โ€

โ€œUnder the standards set in the Magnuson-Stevens Act the nation has made great strides in maintaining more stocks at biologically sustainable levels, ending overfishing, rebuilding overfished stocks, building a sustainable future for our fishing-dependent communities, and providing more domestic options for U.S. seafood consumers in a market dominated by imports,โ€ echoed Oliver.

Both agreed, however, that changes should be made. Oliver noted in particular ways in which overall production could be increased, particularly in areas where catch limits have not been updated to changes in stock sizes.

โ€œFor example, while our West Coast groundfish fisheries have rebuilt several important stocks, in recent years fishermen are leaving a substantial amount of the available harvest of some groundfish species in the water, due to regulatory or bycatch species constraints. We must find ways to maximize allowable harvests that are still protective of non-target species in all of our fisheries,โ€ explained Oliver.

Stakeholders in the West Coast groundfish fishery were enthusiastic about Oliverโ€™s references to the plight of those working in the non-whiting trawl catch shares program. The program has realized far less than full utilization of the resource, with less than one-third of the available fish being harvested annually.

โ€œWe applaud Chris Oliverโ€™s recent testimony to the Senate on the state of the West Coast IFQ non-whiting trawl fishery,โ€ Pacific Seafoodโ€™s Mike Okoniewski said.

โ€œMembers of industry have been testifying for years that while the conservation benefits of the program have passed all expectations, but the economics are performing at abysmal levels,โ€ Okoniewski said.

Oliverโ€™s testimony drilled to the heart of the matter: if you cannot get the fish out of the water you cannot realize the economic benefits outlined in the programโ€™s goals and objectives. Targets such as increasing economic benefits, providing full utilization of the trawl sector allocation, increasing operational flexibility and providing measurable economic and employment benefits throughout the processing and distribution chain have not been met for the non-whiting sector.

โ€œChris Oliverโ€™s testimony is a huge step forward to reverse the present trajectory we are on. Again we thank him and look forward his leadership of NMFS. His focus on balance and economic output, as well as conservation and sustainability, is long overdue,โ€ Okoniewski said.

โ€œMuch like Pacific groundfish (to quote AA Oliver), New England groundfish fishermen โ€˜are leaving a substantial amount of the available harvest of some groundfish species in the water, due to regulatory or bycatch species constraintsโ€™โ€, noted Maggie Raymond, Executive Director of Associated Fisheries of Maine.

Both Quinn and Oliver referenced a need for โ€œflexibilityโ€, Raymond observed.

โ€œQuinnโ€™s testimony is specific to a need for flexibility in rebuilding timelines.  But flexibility in rebuilding timelines is not necessarily the fix, at least not for New England,โ€ she added.

โ€œAs long as an otherwise healthy mixed stock fishery remains constrained by a weak stock in the complex, the problem of leaving available harvest in the water cannot be addressed.  We look forward to working with AA Oliver to โ€˜find ways to maximize allowable harvests that are still protective of non-target species.โ€™

โ€œLetโ€™s start with windowpane flounder. A species with no economic value that puts a significant burden on the NE groundfish and scallop fisheries,โ€ said Raymond.

Oliver acknowledged his testimony from last year on no need for further flexibility on MSA. But, he said, โ€œIโ€™m in a new role now and as I look at the issue more broadly, Iโ€™d heard from constituents across the country, listened to the dialog about issues with the Act, and Iโ€™ve come to believe that there is a possibility that additional flexibilities should be considered, accountability measures that are used to enforced annual catch limits (ACLs), particularly in fisheries where we donโ€™t have the robust and accurate accounting.

โ€œMany of our recreational fisheries are of a nature that donโ€™t lend themselves well to those monitoring methods.

โ€œThe administration has not taken positions on these specific issues,โ€ Oliver said. โ€œBut in my personal view, in fisheries that donโ€™t have robust systems of accountability, in particular the recreational fisheries that have different goals, thereโ€™s room for flexibility.โ€

Quinn agreed. โ€œWeโ€™re here to reauthorize [the MSA], not repeal it. Data availability and stock assessment, particularly in the recreational side, I think weโ€™ve got a lot of work to do. Data needs are really important. ACLs and AMs work for the commercial, not necessarily for the recreational fisheries.โ€

Senator Cory Booker (D-NJ) called the nationโ€™s bycatch quantity โ€œunacceptableโ€ and asked Quinn for an assessment on catch shares.

โ€œIn some parts of the country, catch shares have worked,โ€ Quinn responded. โ€œIn my part of the country, it hasnโ€™t worked as well. But the CCCโ€™s position is to keep catch shares as a part of our management tool box.โ€

Sullivan brought up the issue of electronic monitoring as a less expensive alternative to onboard observers and asked, โ€œWhat can we do to help the councils use EM more efficiently?โ€

โ€œLike catch shares, the authority for EM is in the Act now,โ€ said Quinn, โ€œbut individual regions may have specific fisheries that may or may not use EM. There are a lot of pilot programs using EM now. Decisions should be made region by region.โ€

โ€œI want to compliment you both on your emphasis on data and science,โ€ Sullivan said in closing comments. โ€œWeโ€™re going to back you up on that.โ€

The next hearing will be August 23, 2017 in Kenai, Alaska.

Fish council likely give input on Rafael permits

June 13, 2017 โ€” The New England Fishery Management Council could adopt a formal recommendation to NOAA Fisheries on the ultimate redistribution of Carlos Rafaelโ€™s groundfish permits when it convenes next week in Portland, Maine.

The council, set to meet next Tuesday through Thursday, faces a busy agenda of items, including a summary of public comments on groundfish monitoring, as well as possible final actions on the coral amendment and the framework dealing with skates.

But the question of what should happen to Rafaelโ€™s stable of more than 40 groundfish permits once the New Bedford fishing magnate is sentenced โ€” now scheduled for July 28 โ€” may generate the most heat at the three-day meetings.

โ€œThat issue has generated a lot of interest and opinion among the fishing community and the council could develop an official comment that could be positioned in a recommendation letter to (NOAA Fisheries),โ€ said Janice Plante, council spokeswoman.

The council is set to hear from its Groundfish Committee late next Tuesday morning, including a discussion on the interim final rule for 2017 and 2018 fishing sector operation plans and โ€œwhether measures or restrictions should be recommended for Sector 9 due to misreporting by sector vessels.โ€

As part of an agreement with federal prosecutors, Rafael pleaded guilty in late March to falsifying fish quotas, conspiracy and tax evasion. The man known on the docks as โ€œThe Codfatherโ€ may have to surrender up to 13 of his groundfishing vessels โ€” which continue to fish as members of Northeast Fishing Sector 9 โ€” and will pay almost $109,000 in restitution to the Internal Revenue Service.

The commercial groundfish industry has roiled over the question of what to do with all of Rafaelโ€™s groundfish permits now that he has pleaded guilty to multiple federal charges.

Officials and fishing stakeholders in New Bedford have insisted the permits should remain there, even if divvied up to other groundfishermen. Other stakeholders โ€” such as Maggie Raymond, executive director of the Associated Fisheries of Maine โ€” argue that Rafael should be stripped of all of his permits.

MAGGIE RAYMOND: Carlos Rafaelโ€™s Fishing Permits Should be Redistributed

June 5, 2017 โ€” Dear Editor:

Carlos Rafaelโ€™s environmental crime spree, spanning two decades, will finally come to an end. Rafael pleaded guilty to federal charges of falsifying fish catch reports, conspiracy and tax evasion. He will serve at least four years in jail and will forfeit millions of dollars in fishing assets. For law-abiding fishermen, this day is long overdue.

While other fishermen were complying with steep reductions in fishing quotas, Rafael decided those rules didnโ€™t apply to him. Rafaelโ€™s violations set back groundfish rebuilding requirements, and forced others to compete with his illegal activity on the fishing grounds and in the market. Rafael has harmed the entire groundfish industry, and fishermen from Maine to New York deserve to be compensated.

Rafaelโ€™s history is so egregious that the National Marine Fisheries Service is obliged to cancel all his groundfish permits and fishing privileges. Existing regulations describe a process for redistributing the fishing privileges from canceled permits to all other permit holders in the fishery, and this is precisely the process that should be followed in this case.
