Maine delegates decry ‘broken promise’ in China lobster-buying deal

February 22, 2022 — All four members of Maine’s congressional delegation want the Biden administration to hold China accountable for its apparent failure to live up to a 2020 trade deal.

In a letter sent Thursday to U.S. Trade Representative Katherine Tai, Sen. Angus King and Reps. Chellie Pingree and Jared Golden said China has broken its promise to buy more Maine lobster. They also requested details on exactly how much lobster China agreed to buy under the trade deal, which was negotiated and signed during the Trump administration. Sen. Susan Collins sent Tai a similar letter Wednesday.

Recent analyses indicate that China has failed to buy all of the additional $200 million in U.S. goods that trade officials said the country committed to in the “Phase One Deal” unveiled in early 2020. An analysis by Bloomberg released last month said China had only purchased 63 percent of the U.S. goods it had agreed to buy as part of an effort to reduce the trade deficit between the two countries.

In their letter, King, Pingree and Golden said China has bought “almost no lobster above 2017 levels” and said U.S. officials need to take action to make sure the additional purchases spelled out in the agreement take place.

Rep. Pingree, New England lawmakers urge Biden administration to study sustainable offshore wind development

February 22, 2022 — Rep. Chellie Pingree and other New England lawmakers are pressuring federal ocean regulators charged with siting offshore wind energy projects to pay close attention to the health of Gulf of Maine ecosystems and fishermen.

Pingree chairs a House Appropriations subcommittee that oversees the Bureau of Ocean Energy Management’s budget, and she’s concerned that with the Biden administration’s push to open up new offshore leases as soon as 2024, the gulf’s ecosystems and economies might get overlooked.

US requests discussions with Mexico over vaquita protections

February 15, 2022 — The administration of U.S. President Joe Biden has asked the Mexican government to provide environmental consultations regarding its efforts to protect the critically endangered vaquita.

U.S. Trade Representatives Katherine Tai said in a press release on Thursday, 10 February, the request is tied to making sure Mexico “lives up to” the environmental commitments laid out in the U.S.-Mexico-Canada trade agreement.

Lawsuit challenges Vineyard Wind approval

February 1, 2022 — A lawsuit challenging the federal approval of the nation’s first industrial-scale offshore wind farm off the coast of Massachusetts raises questions about the haste with which the project was approved and the fallout it will have on endangered right whales and the fishing industry.

The lawsuit, filed on Monday in federal court in Washington, DC, by the Responsible Offshore Development Alliance, which represents fishing interests, also highlights the dramatic scale of the wind farm and questions whether taxpayers were shortchanged by the leases the federal government negotiated with the developer, Vineyard Wind.

The lawsuit is one of a handful challenging the project on the grounds that several environmental statutes were violated in the Biden administration’s rush to kickstart the offshore wind industry.

Vineyard Wind filed its construction and operations plan initially in 2017. The Trump administration decided to extend its review indefinitely in 2019 to take into account the many offshore wind farms planned up and down the coast.

Construction to begin soon on new US offshore wind farm

January 20, 2022 — Construction will soon begin on the second commercial-scale, offshore wind energy project to gain approval in the United States, the developers said.

The U.S. Department of the Interior approved it in November, and the Bureau of Ocean Energy Management issued its approval letter for the constructions and operations plan Tuesday, a major step in the federal process before construction can start.

Orsted, a Danish energy company, is developing the South Fork Wind project with utility Eversource off the coasts of New York and Rhode Island. They now expect the work onshore to begin by early February and offshore next year for as many as 12 turbines.

President Joe Biden has set a goal to install 30 gigawatts of offshore wind power by 2030, generating enough electricity to power more than 10 million homes. In November, work began on the first commercial-scale offshore wind farm in the United States, the Vineyard Wind 1 project off the coast of Massachusetts.

US races to meet climate goals under Paris Agreement

But a big push by the Biden administration to change that is under way, to meet clean-energy commitments made under the Paris Agreement.

Biden administration turning attention to seafood’s labor issues

January 14, 2022 — The administration of U.S. President Joe Biden has released an action plan to combat human trafficking at home and abroad, an initiative that includes a focus on labor issues in the global seafood industry.

The U.S. Trade Representative National Action Plan to Combat Human Trafficking, released in December 2021, involves better coordination among American agencies as well as with other countries’ law enforcement bodies to track and prosecute human trafficking on fishing vessels and in onshore seafood processing facilities. Under the plan, the USTR will ramp up its efforts to encourage other countries to put in place bans on imports of goods made with forced labor.

BOEM to offer six New York Bight wind leases in Feb. 23 auction

January 13, 2022 — The Biden administration announced plans Wednesday to auction more than 480,000 acres in the New York Bight for six new offshore wind energy leases, the administration’s first wind sale and the largest lease area ever offered, with a potential build-out capacity up to 7 gigawatts.

In a joint announcement with governors of New York and New Jersey, Interior Secretary Deb Haaland said the “administration has made tackling the climate crisis a centerpiece of our agenda, and offshore wind opportunities like the New York Bight present a once-in-a-generation opportunity to fight climate change and create good-paying, union jobs in the United States. We are at an inflection point for domestic offshore wind energy development. We must seize this moment – and we must do it together.”

Commercial fishing advocates stressed that BOEM needs to make a priority of avoiding and mitigating negative impacts their industry and the nation’s seafood supply.

The waters between New York and New Jersey are some of the most productive on the East Coast and account for much of the sea scallop harvest, valued at $746 million in 2019, according to the Fisheries Survival Fund.

In comments submitted to the agency, the group called on BOEM “to create an ‘adaptive and proactive mitigation plan’ that will allow both fisheries and offshore wind to prosper.”

“It is unquestionable that the proliferation of new turbine arrays will have detrimental impacts on the scallop fishery and other fisheries,” according to a statement from the Fisheries Survival Fund. “Windfarms will and demonstrably do change ocean ecosystems. The goal of mitigation should be to strike a balance that ensures mutual prosperity, not merely an uneasy, zero-sum co-existence.”

Biden Clean Power Push Hits New York With Offshore Wind Sale

January 12, 2022 — The Biden administration is preparing to sell offshore wind rights near New Jersey and New York, a down-payment on its bid to decarbonize the U.S. power grid and generate renewable electricity from nearly all U.S. coasts.

Under the auction, which could be announced as soon as Wednesday, the U.S. government aims to sell leases to install wind turbines in shallow Atlantic waters between New Jersey and New York’s Long Island, with the potential to generate some 7 gigawatts of carbon-free electricity.

As a sign of the opposition, a conservation group on Monday sued the Interior Department’s Bureau of Ocean Energy Management, asking a federal court to reverse the agency’s March 2021 decision to recommend five areas for offshore wind projects in the New York Bight.

Save Long Beach Island told the U.S. District Court for the District of Columbia that the bureau failed to study the effects the projects would have on the environment. The group also faulted the agency for failing to consult with the National Marine Fisheries Service to determine if any wind project would affect North Atlantic right whales or other protected species.

Separately Tuesday, groups representing fishing interests, including the Responsible Offshore Development Association, urged the bureau to take more steps to limit the impacts of offshore wind development, including by developing formal benchmarks to assess projects.

Gulf of Mexico Swordfish: Lingering covid effects, cheap imports depress market

December 22, 2021 — Low production, the ongoing covid-19 health and economic crisis, and a flood of product from Canada are depressing the U.S. commercial swordfish market in the Gulf of Mexico and South Atlantic, according to some industry members.

“Production levels are the lowest they’ve been since the beginning of time,” lamented Scott Taylor, operator of Day Boat Seafood in Fort Pierce, Fla. “There have been no positive developments whatsoever. I have more boats sitting at the dock than I have fishing.”

Taylor cited a litany of hits to the fishery: Covid’s impacts on the restaurant industry which drives U.S. demand for swords; new U.S. government regulations, including gear restrictions and the possible closure by the Biden administration of New England’s fish-rich Northeast Canyons and Seamounts Marine National Monument; a deluge of cheaper product from Canada dumped in U.S. markets recently; rising fuel prices; and a lack of new blood entering the U.S. commercial fishing industry.

Taylor said the average boat price is about $4, which he calls “unsustainable.”
