NOAA Fisheries Announces Proposed Management Measures for the 2016-2018 Atlantic Herring Fishery

June 22, 2016 โ€” The following was released by NOAA Fisheries:

NOAA Fisheries announces proposed management measures for the Atlantic Herring fishery for the 2016-2018 fishing years. The proposed catch limits for fishing years 2016 through 2018 are slightly lower than the current catch limits because the most recent assessment shows a slightly lower spawning stock biomass and a slightly higher fishing mortality.

We are also proposing to increase the catch cap limits for river herring and American shad to increase access to the fishery, while still providing sufficient protection for these species.

New Approach to Scallop Monitoring Results in Re-Opened Fishing Grounds

March 9, 2016 โ€” The following was released by the Maine Department of Marine Resources:

A new approach to scallop monitoring in Maine state waters has led to changes in scallop abundance estimates that will result in the reopening of three important fishing grounds this season.

The areas opening are Inner Machias Rotational Area, Wahoa/Jonesport Reach and Gouldsboro Bay and Dyers Bay, which were closed through emergency rulemaking by the Maine Department of Marine Resources on December 13, 2015. The Department will open the areas the week of March 14 by allowing the emergency regulation to lapse.

โ€œThe Maine scallop fishery has seen significant advances in both science and management in recent years,โ€ said Maine DMR Science Bureau Director Carl Wilson. โ€œIn 2012 the DMR, working closely with industry, implemented rotational management and targeted in-season closures. These new management tools were developed to continue rebuilding the resource in areas that had been closed for three years, while supporting a sustainable fishery.โ€ 

Under the new management strategy, pre-season dredge surveys were used by the DMR to estimate abundance and harvestable biomass in areas likely to be subject to heavy harvesting pressure. DMR staff uses estimates of scallop biomass removed from these areas based on port sampling, sea sampling, and industry feedback to make decisions about timing of in-season closures. Closures occur when 30%-40% of the harvestable biomass in an area has been removed.

To further improve understanding of the scallop resource and the impacts of the fishery, the Department piloted in-season dredge surveys in Cobscook Bay during the 2014-15 fishing season. Results from the 2014-15 in-season surveys allowed Cobscook Bay to remain open two weeks longer than the pre-season survey originally supported. โ€œThis is a valuable tool that we are using to validate our initial projections,โ€ said Wilson.

During the current 2015-16 season, in-season surveys have been used in Cobscook Bay as well as Machias Bay, Gouldsboro Bay and western Vinalhaven. After comparing results of the pre and in-season surveys, DMR scientists found discrepancies that needed further investigation to fine-tune biomass estimates and projections.

As a result of this in depth analysis, Department scientists determined that there remains approximately 13,500 pounds in the Inner Machias Rotational Area and 4,500 pounds in Gouldsboro Bay to be harvested.

Corrected projections of harvestable biomass and in-season surveys both revealed that less than the targeted 30% of the harvestable biomass had been removed from these areas, both of which were closed by emergency action in December 2015. As a result, these areas along with Wahoa/Jonesport Reach and Dyers Bay will temporarily re-open to fishing the week of March 14.

โ€œThe in-season surveys allow DMR scientists to better evaluate pre-season estimates and to more effectively assess the scallop resource in specific areas,โ€ said Wilson. โ€œThis in turn enhances the timeliness and precision of management decisions. This season, the additional analysis has provided Maine scallop harvesters with late season fishing opportunity.โ€

Herring vs. Haddock in Data Debate

February 3, 2016 โ€” PORTLAND โ€” Last October, the National Marine Fisheries Service (NMFS) drastically constrained the ability of midwater trawlers to fish for herring in offshore waters for a period of more than six months, because the herring fleet had bumped up against its quota for the incidental catch of Georges Bank haddock.

As a result, at its December meeting, the New England Fishery Management Council (NEFMC) heard a request from herring fishery interests to reconsider the level of constraint for the upcoming fishing year of May 1, 2016 to April 30, 2017, and for future years, since Georges Bank haddock appears to be plentiful and, they said, estimates of haddock catches by the herring fleet were inaccurate.

โ€œA seven-month closure of a major fishery is very significant,โ€ said NEFMC member Mary Beth Tooley, who is the government affairs representative for Rockland-based Oโ€™Hara Corp., which owns and operates two herring vessels. โ€œWe in the herring fishery donโ€™t want to catch haddock. But that biomass is like locusts: Theyโ€™re unbelievably abundant. Itโ€™s two-pronged: Letโ€™s get groundfishermen catching haddock, and not close the herring fishery.โ€

Tooley said the herring industry agrees that there should be a limit on what the herring fishery takes from the haddock resource, and that accountability measures to enforce the limit are needed. But the methodology currently used to extrapolate estimates of how much haddock the herring fleet incidentally catches isnโ€™t accurate, she said, and monitoring of harvesting operations, through observer or electronic programs, is inadequate for providing an accurate count of haddock catch.

โ€œWe need to have accountability,โ€ Tooley said. โ€œBut with our current level of [observer] coverageโ€ฆitโ€™s become a real issue.โ€

In an action that became effective Oct. 22, 2015, herring midwater trawl vessels were prohibited from fishing for more than 2,000 pounds of herring per trip or day in the โ€œHerring Georges Bank Haddock Accountability Measure Area,โ€ a limit that will remain in place until the quota becomes available for the 2016 fishing year, on May 1.

The action effectively limited the midwater trawl fishery in Herring Management Area 3, because Area 3 falls within the Georges Bank Haddock Accountability Management Area.

Federally permitted herring vessels, all together, are allowed to catch 1 percent of the Georges Bank haddock resource. The overall allowable haddock catch on Georges Bank for 2015 was 53.7 million pounds (24.3 metric tons); 1 percent, which is further reduced a bit to account for management uncertainty, is 500,449 pounds (227 mt), according to NMFS.

According to data reported on Dec. 21, 2015, based on estimated haddock catches, the herring midwater fleet had reached 93.09 percent of its quota by September, and 104.49 percent by October.

The amount of haddock caught by the herring fleet is extrapolated from the amount of haddock caught on observer trips.

Maine issues emergency closure to scalloping around Vinalhaven, Fox Island Thorofare

January 14, 2016 โ€” AUGUSTA, Maine โ€” The Department of Marine Resources in-season surveys conducted on Jan. 7 and 8, in specific scallop-fishing regions observed significant declines in scallop biomass densities, according to a Jan. 14 news release.They also determined that seed scallops were being illegally taken.

โ€œAn immediate conservation closure is necessary to reduce the risk of unusual damage and imminent depletion of the scallop resource in the Vinalhaven and Fox Island Thorofare and the Whiting and Dennys Bays,โ€ said the DMR.

Therefore, DMR is adopting emergency regulations to close these areas Saturday, Jan. 16. In addition, a correction to the South Portland Harbor Targeted Closure will also be included to ensure enforceability of this area.

Vinalhaven and Fox Island Thorofare

In the Lower Penobscot Bay and Outer Islands Rotational Area, Marine Patrol, sea sampling, in-season surveys and direct industry reports indicate that the majority of fishing activity has been focused in the Fox Island Thorofare and around the inshore islands (Leadbetter, Hurricane, and Greens Islands) west and southwest of Vinalhaven.

Strong catches were reported during the first three weeks of the season, with upward of 20 vessels fishing and easily able to reach their daily landings limit by as early as 10 a.m. However, over the following weeks, Catch per unit effort decreased with vessels taking the majority of the day to reach their daily landings limit and the fleet began working in more exposed areas outside of the sheltered islands, indicating that the majority of legal sized scallops had been harvested from these areas.

MAFMC Revises 2016 Spiny Dogfish Specifications

December 16, 2015 โ€” The following was released by the Mid-Atlantic Fishery Management Council:

The Mid-Atlantic Fishery Management Council has revised the spiny dogfish specifications that were previously recommended for the 2016 fishing year. During the December 2015 Council Meeting last week in Annapolis, Maryland, the Council approved a revised acceptable biological catch (ABC) limit of about 52 million pounds and a commercial quota of 40 million pounds. The revised commercial quota represents an increase of nearly 60% relative to the quota originally recommended for 2016. In addition, the Council approved ABCs of 51 million pounds for 2017 and 50 million pounds for 2018. 

At a previous meeting in October, the Council had recommended substantial reductions in spiny dogfish catch limits for 2016, including a 50% cut in the commercial quota, in response to the findings of the 2015 spiny dogfish stock assessment update. Although the update concluded that the stock was neither overfished nor subject to overfishing, the new estimate of stock biomass had decreased markedly. The Councilโ€™s recommendations would have reduced the commercial quota for spiny dogfish by 50% next year. 

However, the Council expressed concern that the spiny dogfish assessment update did not include any data from 2014 โ€“ the result of mechanical issues with the Northeast Fisheries Science Center (NEFSC) trawl survey vessel โ€“ and requested that the SSC work with the NEFSC to evaluate alternative ABC-setting methods that could address this data gap. Three different methods for calculating spiny dogfish biomass were evaluated, and the SSC identified a Kalman filter as the best available approach for overcoming the missing data. 

Using the alternative approach, the SSC recommended ABCs that resulted in commercial quotas of approximately 40 million pounds for 2016, 39 million pounds for 2017, and 38 million pounds for 2018. This represents a 20% reduction in quotas from 2015 to 2016. However, landings have been below 50% of the commercial quotas for the last two full fishing years, and the reduced quota is unlikely to be constraining. 

After considering additional public comment during last weekโ€™s meeting, the Council accepted the SSCโ€™s revised ABC recommendation and associated management measures. The New England Fishery Management Council also approved similar specifications at its December meeting for this jointly-managed species, and if approved by the National Marine Fisheries Service, the new measures will go into effect May 1, 2016.

Moratorium on Northern Shrimp Commercial Fishing Maintained for 2016 Season

December 8, 2015 โ€” PORTSMOUTH, N.H. โ€“ The following was released by the Atlantic States Marine Fisheries Commission:

In response to the depleted condition of the northern shrimp resource, the Atlantic States Marine Fisheries Commissionโ€™s Northern Shrimp Section extended the moratorium on commercial fishing for the 2016 fishing season. The 2015 Stock Status Report for Gulf of Maine (GOM) Northern Shrimp indicates abundance and biomass indices for 2012-2015 were the lowest on record for the 32-year time series. The stock has experience failed recruitment for five consecutive years, including the three smallest year classes on record. As a result, the indices of fishable biomass from 2012-2015 are the lowest on record. 

Recruitment of northern shrimp is related to both spawning biomass and ocean temperatures, with higher spawning biomass and colder temperatures producing stronger recruitment. Ocean temperatures in western GOM shrimp habitat have increased over the past decade and reached unprecedented highs in 2011 and 2012. While 2014 and 2015 temperatures were cooler, temperatures are predicted to continue to rise as a result of climate change. This suggests an increasingly inhospitable environment for northern shrimp. The Northern Shrimp Technical Committee considers the stock to have collapsed with little prospect of recovery in the immediate future. To maintain the time series of data collected from northern shrimp commercial fishery catches, a cooperative winter sampling program was approved with a 22 metric ton research set aside quota. The goal of the program is to continue the winter time series of biological data (e.g. size composition, egg hatch timing) collected from GOM northern shrimp fishery catches in the absence of a fishery.  Four trawl vessels will be contracted to fish four regions with a maximum trip limit of 1,800 pounds, and two trappers with a weekly trap limit of 40 traps and a 600 pound per week limit. Participating trawlers and trappers will be able to sell their catch.  Trawlers will also be compensated $500/trip. 

โ€œConsidering survey indices are the lowest on record, with an unprecedented five consecutive years of weak recruitment and continuing unfavorable environmental conditions, the Section maintained the moratorium in 2016,โ€ stated Northern Shrimp Section Chair Mike Armstrong of Massachusetts. โ€œThe Section is committed to protecting the remaining spawning biomass and allowing as much reproduction to take place as possible.โ€

Statement by U.S. Commissioner Russell F. Smith III at the Conclusion of the 2015 Annual ICCAT Meeting

December 3, 2015 โ€” The following was released by NOAA Fisheries: 

This yearโ€™s International Commission for the Conservation of Atlantic Tunas (ICCAT) meeting was characterized by an unprecedented level of engagement from a broad range of parties that joined together to promote the sustainable management in ICCAT fisheries. This collaboration is critical to the effective work of ICCAT, and we hope that these relationships will continue to be fostered and strengthened in the future.

Negotiations on amendments to the 1969 ICCAT Convention were advanced to a near-final stage. The amended Convention will reflect modern principles, such as the precautionary and ecosystem approaches to fisheries management, clarify the Commissionโ€™s management authority, particularly for sharks, and improve the governance of the Commission.

In keeping with another major U.S. priority, the electronic system for tracking bluefin tuna catch and trade is near completion and is anticipated to be ready for full implementation in the spring of 2016. This should help address and prevent illegal, unreported and unregulated (IUU) fishing and help improve management of the stock by providing ready access to data about catch and trade.

Agreement was reached on the development of harvest control rules and management strategy evaluation as important tools to support future decision-making. This measure details the process by which alternative biological reference points (i.e., threshold and limit biomass levels, and the target fishing mortality rate) will be identified and tested by the Standing Committee on Research and Statistics (SCRS). North Atlantic albacore will be the first stock; a management objective has been defined and the development of harvest control rules will continue in 2016. The Commission will provide specific input in three areas for individual stocks: (1) management objectives; (2) acceptable levels of probability (e.g., of achieving targets or avoiding limits); and (3) timeframes for ending overfishing and/or rebuilding.

We are disappointed that the Commission did not do more to address overfishing of bigeye tuna despite the clear advice from the SCRS, which called for a reduction in the total allowable catch (TAC) and in the fishing mortality on the smallest juvenile bigeye tuna that are caught in the Gulf of Guinea. Tropical tunas support important U.S. commercial and recreational fisheries. With this in mind, we sought a more comprehensive approach to rebuild the stock with greater certainty, including a lower TAC as well as a longer and larger time/area closure to protect juveniles. Although these positions were rejected by the major players in the fishery, we will continue to manage bigeye tuna responsibly within the United States.

Atlantic-wide TAC levels for overfished stocks of blue marlin and white marlin will remain in effect until new scientific advice is available in 2018. We had hoped to include provisions to require the use of circle hooks to minimize post-release mortality, and related scientific research, but these efforts were rejected.

With respect to sharks, a new measure requires the release of porbeagle sharks encountered alive in ICCAT fisheries and, if catches of porbeagle increase beyond 2014 levels in the future, additional actions will be considered. The United States again proposed to prohibit shark finning at sea and to require sharks that are landed to have fins naturally attached. The number of co-sponsors for this proposal increased substantially, from 12 in 2014 to 30 in 2015, now more than a majority of all ICCAT parties. Despite this groundswell of support, a few parties declared their staunch opposition to this measure, and it was not adopted.

ICCAT invested a significant amount of time and effort to review the compliance of its 50 Contracting Parties with existing obligations, evaluating various reporting requirements as well as conservation and management measures. There was demonstrated improvement in ICCAT partiesโ€™ reporting of catch data and other information this year, but there is further work to do to ensure that all parties are in full compliance with all reporting obligations. The United States will continue to push ICCAT and its parties to be forward leaning and to prioritize the implementation of a robust and transparent compliance process.

NOAA: Haddock flourish, while cod stocks dwindle

November 21, 2015 โ€” The groundfish stock updates released this week by the National Oceanic and Atmospheric Administration reflect what the agency says is the continuing deterioration of the Gulf of Maine cod stock, while showing that other stocks such as haddock, pollock and redfish appear to be flourishing.

The operational assessment updates were performed on 20 Northeast groundfish stocks, with the results corresponding to the state of the individual stocks through 2014.

The news for cod, according to the update, is really no news at all.

โ€œBased on this updated assessment, the Gulf of Maine Atlantic cod stock is overfished and overfishing is occurring,โ€ the authors of the report wrote in their executive summary.

The results show the GOM cod spawning biomass to be hovering between 4 percent and 6 percent of what is necessary to sustain a well-managed stock despite three years of Draconian cuts to cod quotas and the more recent shuttering of the Gulf of Maine to all cod fishing.

While the updateโ€™s results continue the trend of NOAA data that show the GOM cod stock near total collapse, they also continue to fly in the face of the season-long insistence by Cape Ann fishermen โ€” commercial, recreational, fin and lobster fishermen โ€” that they have seen more cod this season than in many years past.

Fish Success Story: Cod Makes a Comeback

October 27, 2015 โ€” The cod is coming back.

The species that was for centuries a mainstay of the American and Canadian economies had virtually vanished off the Northeastern North American coast by the 1990s owing to overfishing. That led regulators in 1992 to impose a moratorium on cod fishing.

It appears to have worked.

New research shows that cod biomass has increased from the tens of tons to more than 200,000 tons within the last decade. This spring, scientists documented large increases in cod abundance and size for the first time since the moratorium in the more northerly spawning groups, according to a study published Monday in the Canadian Journal of Fisheries and Aquatic Sciences.

โ€œCod was historically one of the most important fish stocks in the world,โ€ said George Rose, director of the Center for Fisheries Ecosystems Research at the University of Newfoundland in Canada and author of the new report on the codโ€™s recovery. โ€œWhen the stocks collapsed in the 1990s, it became the icon of all the bad things we are doing to the ocean, and in many ways, it changed how we deal with our oceans worldwide.โ€
