NEFMC Seeks Applicants for Climate and Ecosystem Steering Committee

September 27, 2024 — The New England Fishery Management Council is looking for qualified candidates to serve on its new Climate and Ecosystem Steering Committee (Steering Committee).  The application deadline is Friday, October 18, 2024.  Appointment terms are for two years, starting in November 2024, with the possibility for reappointment.

 
COMMITTEE STRUCTURE: The Steering Committee will be comprised of members of the Council and its Scientific and Statistical Committee, NOAA Fisheries and Council staff, members of the fishing industry, and other government and non-government experts with experience in the following key areas:
 
  • Climate scenario planning and climate-resilient fishery management approaches;
  • Ecosystem approaches to fishery management;
  • Fishery stock assessment methods;
  • Governance, policy, and marine user management;
  • Biology, oceanography, and climate science; and/or
  • Social sciences and economics.
 
WHY IS THE COUNCIL CREATING A NEW COMMITTEE: The Council is facing unprecedented challenges associated with climate change and has identified the need to introduce additional flexibility into the management process to address changes in abundance, distribution, and productivity of managed stocks. In recognition of these challenges, NOAA Fisheries is providing funding from the Inflation Reduction Act (IRA) to assist Councils in the transition to climate-resilient fishery management approaches.  Also, as part of its 2024 work priorities, the Council agreed to consider ecosystem approaches across all of its fishery management plans. The Council established the Climate and Ecosystem Steering Committee to provide overarching guidance and support for design and implementation of climate-ready management approaches.  The Steering Committee’s tasks are outlined in the solicitation announcement.
 
WHAT’S INVOLVED: The Climate and Ecosystem Steering Committee will be led by a Council-appointed chair and vice chair.  The committee is expected to meet at least twice annually as a full group with intersessional meetings as needed and report directly to the Council.  The Council will share the group’s recommendations with regional partners.

Council Creates Indigenous Committee to Strengthen Traditional Voices in Pacific Fisheries

September 27, 2024 — The following was released by the Western Pacific Regional Fishery Management Council:

Concluding its 200th meeting, the Western Pacific Regional Fishery Management Council established an Indigenous Committee to provide recommendations to federal authorities on cultural fishing rights and related issues.

Sub-panels for Hawai‘i, American Samoa, Guam and the CNMI will include members with expertise in traditional fishing practices and community ocean activities in their respective regions. The new committee will augment the Council’s Fishery Rights of Indigenous People Standing Committee, which was established in the mid-1980s.

Throughout its 48-year history, the Council has addressed indigenous issues and sought to modify the impact of federal fishery management on Native Hawaiians, Samoans, Chamorros and Carolinians, who have fished in the Western Pacific for centuries. 

With the growing emphasis on ecosystem-based management, traditional ecological knowledge, equity, and environmental justice, the Council created the new Indigenous Committee to ensure culturally relevant recommendations that include indigenous perspectives in the region’s decision-making process.

The Council requested a presentation on how the recognition process for indigenous peoples could work and the benefits an existing system now provides to Native American Tribes. Currently, the United States does not recognize the indigenous peoples of the Western Pacific Region—Kānaka Maoli, Samoans, CHamoru and Refaluwasch—in the same way it does federal Native American Tribes. This difference puts the Pacific groups at a disadvantage in federal relations.

The Endangered Species Act, for example, allows subsistence use of endangered species as a food source for Native American Tribes, but such exceptions were not considered for regional indigenous peoples when the U.S. entered international agreements to protect green sea turtles, a traditional food in the Pacific. Expanded recognition could address existing and future issues affecting Pacific Islanders.

National Marine Sanctuaries in the Pacific

The Council reviewed a NOAA status update on the proposed national marine sanctuaries in the Northwestern Hawaiian Islands (NWHI) and Pacific Remote Islands (PRI). Since March 2024, public hearings have been held across the Hawaiian islands on the draft Environmental Impact Statement (EIS) for the NWHI sanctuary, with no action yet reported on a draft EIS for the PRI sanctuary.

The Council expressed concerns over the process for establishing fishing regulations under the National Marine Sanctuaries Act, section 304(a)(5), contending it fails to provide a clear rationale for why such regulations are necessary. The Council stressed the need for assessing potential threats to sanctuary resources—including fishing—before determining regulations to address those concerns.

The Council bid a fond farewell to Manny Dueñas from Guam whose 3-year term ended in August 2024. He was a Member of the Council for a total of 12 years, having previously served between 2003 and 2012, including as Chair from 2011-2012. Dueñas has led the Guam Fishermen’s Cooperative Association for nearly 40 years, and has been a passionate champion of his culture and fishing rights. During his tenure, the Council provided funds supporting projects for indigenous fishing practices throughout the Western Pacific Region. Seabird, sea turtle and oceanic whitetip shark bycatch mitigation measures were established for the Hawai‘i longline fishery. A major restructuring of managing fisheries was adopted by the Council–instead of species-based, four archipelago ecosystem plans were developed for American Samoa, the CNMI, Guam and Hawai‘i.

The Council’s 201st meeting will be held virtually Dec. 16-18, 2024. Major agenda items will include actions on the Guam bottomfish rebuilding plan, striped marlin stock sustainability, uku stock assessment and catch limits in Hawai‘i, longline vessel crew training and electronic monitoring. NEW JERSEY: New Jersey hits pause on an offshore wind farm that can’t find turbine blades

September 26, 2024 — New Jersey hit the pause button Wednesday on an offshore wind energy project that is having a hard time finding someone to manufacture blades for its turbines.

The New Jersey Board of Public Utilities granted Leading Light Wind a pause on its project through Dec. 20 while its developers seek a source for the crucial components.

The project, from Chicago-based Invenergy and New York-based energyRE, would be built 40 miles (65 kilometers) off Long Beach Island and would consist of up to 100 turbines, enough to power 1 million homes.

Leading Light was one of two projects that the state utilities board chose in January. But just three weeks after that approval, one of three major turbine manufacturers, GE Vernova, said it would not announce the kind of turbine Invenergy planned to use in the Leading Light Project, according to the filing with the utilities board.

Vineyard Wind contractor announcing hundreds of layoffs

September 26, 2024 — The contractor hired by Vineyard Wind to install 62 turbines south of the Island is reporting significant financial losses amid damages to turbine blades in multiple projects, and most recently, they are announcing intentions to downsize while pushing forward with billions of dollars in unfinished work.

GE Vernova, who have contracts to manufacture and install turbines around the world, said last week that they plan to cut as many as 900 jobs.

“The proposal reflects industry wide challenges for wind and aims to transform our Offshore Wind business into a smaller, leaner and more profitable business within GE Vernova,” a spokesperson told The Times in an email statement.

The announcement was made in a report to the European Works Council, which represents workers. Vernova did not specify where the job losses would be felt, but a spokesperson did say that they plan to finish out existing projects, including Vineyard Wind.

US fishery management council’s structure is unconstitutional, court rules

September 26, 2024 —   A divided federal appeals court on Wednesday stripped a regional fishery management council of its ability to block the U.S. Secretary of Commerce from taking actions to manage fisheries that the panel does not support, after finding the council’s members were unconstitutionally appointed.

The Philadelphia-based 3rd U.S. Circuit Court of Appeals on 2-1 vote sided with two commercial fishermen who had sued after Mid-Atlantic Fishery Management Council amended a fishery-management plan to lower how much scup, summer flounder and black sea bass could be caught in their region.

The fishermen, Raymond Lofstad and Gus Lovgren, challenged the constitutionality of the structure of the body, one of eight regional councils nationally tasked with developing fishery management plans, in their lawsuit. They are being represented by the libertarian Pacific Legal Foundation in their lawsuit.

That 21-member council oversees the waters from New York down through Virginia. Seven of its members are appointed by state governors and 13 are appointed by the commerce secretary and the regional director of the National Marine Fisheries Service.

ALASKA: Cook Inlet fisheries to get $9.4M in disaster relief for 2018, 2020

September 26, 2024 — Two Cook Inlet salmon fisheries will receive more than $9.4 million in federal disaster relief that was held up, in part, by technical difficulties. They’re among ten Alaska fisheries getting money, the state’s Congressional delegation announced Friday.

In all, ten fisheries across the state will receive $277 million for disasters dating back to 2018. They include 2020’s Upper Cook Inlet salmon fishery and 2018’s Upper Cook Inlet east side setnet fishery.

Other fisheries that will receive money through the distribution include Bering Sea crab, Kuskokwim River and Norton Sound salmon and Gulf of Alaska pacific cod.

However, Friday’s announcement comes almost six months after U.S. Rep. Mary Peltola called on U.S. Commerce Secretary Gina Raimondo to address payment holdups caused by a software glitch.

Last year, the National Oceanic and Atmospheric Administration, started using new accounting software, Business Applications Solution. NOAA is one of the agencies responsible for moving relief funds through the federal government. Peltola says problems with that software have held up disaster relief.

UN chief warns of ‘rising tide of misery’ from swelling seas

September 26, 2024 — UN chief Antonio Guterres warned on Wednesday that surging sea levels are creating “a rising tide of misery,” as a coalition of small island nations declared that their sovereignty must be respected even if their lands are subsumed.

Nearly a billion people worldwide live in low-lying coastal areas, increasingly vulnerable to storm surges, coastal erosion and flooding — while Pacific islands face growing threats to their economic viability and even existence.

Since the beginning of the 20th century, the global mean sea level has risen faster than in any prior century over at least the past 3,000 years, a direct consequence of human-caused global warming triggering the melting of ice on land and the thermal expansion of seawater.

“Rising seas mean a rising tide of misery,” said Guterres, speaking at a summit that placed sea-level rise at the top of the international agenda at the UN General Assembly.

Over the past century, as global temperatures have risen about one degree Celsius (1.8F), sea levels have gone up 160 to 210 millimeters (six to eight inches) — with about half of that amount occurring since 1993, according to NASA.

MASSACHUSETTS: Bay State’s offshore wind prices about to reset

September 26, 2024 — Massachusetts residents already pay some of the highest electricity prices in the country and the state is going to need a lot more power as it tries to make a big shift away from fossil fuels. So how much will it cost to generate cleaner electricity with offshore wind?

The pricing details for the state’s latest slate of offshore wind projects won’t be available until contracts are put on file this winter and it is clearly a sensitive topic for the industry and its boosters in state government. The projects chosen this month are widely expected to cost ratepayers more than previous projects, and the Healey administration would only say that they will be cost effective when compared to the cost of building other power generation projects in the future.

Boston area electricity prices were 64 percent above the national average last month, federal data show, and Massachusetts abandoned its attempt at forcing a declining cap on offshore wind power prices in 2022 when it eliminated the legal requirement that each new project selected charge a lower price than the previous one.

HAWAII: Oahu offshore wind farm plan gets blowback

September 26, 2024 — A company partly backed by the government of France is working to advance an Oahu offshore wind energy project as a federal agency prepares to possibly auction an ocean lease for such use in 2028.

Aukahi Energy LLC, a joint venture involving a subsidiary of French utility giant EDF Group, in recent months has publicly shared its vision to put 22 to 30 floating wind turbines — each taller than a football field — between Oahu and Molokai to supply about 25% of the electricity used on Oahu at an estimated cost of over $1.8 billion.
